We at Align by Ami (“ABA”, “we”, “our” or “us”) are committed to protecting the privacy rights of individuals. This Privacy Policy (“ABA’s Privacy Policy”) explains how ABA handles information relating to an identified or identifiable individual (“Personal Information”) that is provided to ABA or that ABA collects when you visit our website www.alignbyami.com or our booking system at book.alignbyami.com (together, the “Website”) and/or avail our Service(s).
This Privacy Policy specifically informs you about the types of Personal Information that we collect or process, why such Personal Information is processed, how it is used and what rights you have. Please note that this Privacy Policy does not apply to Personal Information collected by/on any third-party site or application (including advertising) that may be linked to or be accessible from our website. ABA is not responsible for the privacy policies or data collection, use and disclosure practices of those third-party sites. We encourage you to review the privacy policies of each site you visit independently.
For the purpose of this Privacy Policy, the term “Personal Information” would mean any information relating to an identified or identifiable individual as further defined in applicable data privacy laws and regulations. The terms “you,” “your,” and “yours” refer to anyone utilizing the Website. The terms “ABA”, “Align”, “we,” “us,” and “our” refer to ABA and its affiliates. By using the Website, you consent to the practices set forth in this Privacy Policy. We may periodically make changes to this Privacy Policy that we will include on this page. It is your responsibility to review this Privacy Policy frequently and remain informed about any changes.
Types of Information Collected
Customer Account and Inquiries: If you are an existing Customer or prospective Customer (or a representative or employee), we collect and process your Personal Data when you (i) visit the Website or make a request to receive information about our Service(s), including to book an appointment, (ii) contact our sales team or customer support team, and (iii) sign up for our Service(s).
We collect your name, email address, and contact information when you make a booking or create an account. We also collect information relating to your payment and billing information, phone number, country location and the actions that you perform while using the Website. We also collect customer support information including the information you choose to include in communications with us over call, message or while availing our Service(s), such as allergy information you share when pre-ordering a beverage.
Health Information: The nature of an appointment you book, and notes you or your practitioner record in connection with your care, may reveal information about your health. We treat this information as confidential, use it only to provide safe and appropriate care, and restrict access to it to the clinical and administrative staff who need it.
Payments: Payments are processed by ICICI Bank’s secure payment gateway or by UPI. We never see or store your card number, CVV, or UPI PIN. We keep the amount, payment reference, invoice and payment status for our accounts.
Messages: We keep records of booking confirmations, reminders, and receipts we send you on WhatsApp and email, and the replies you send to our WhatsApp number.
Employment at ABA: If you apply for a job posting or become an employee, we collect necessary Personal Data such as those in your resume. In case you become an employee the information collected may include your Aadhaar Number, PAN, Bank Account details, Educational qualifications and certifications, etc.
Our Social Media Pages: We have pages on social media sites like Facebook, Instagram, Twitter, and LinkedIn (“Social Media Pages”). We may collect Personal Data from you when you interact with our Social Media Pages, such as the Facebook “like” button and other sharing widgets (“Social Media Features”). You may be given the option by such Social Media Features to post information about your activities on a website to a profile page of yours that is provided by a third party social media network in order to share with others within your network. Social Media Features are either hosted by the respective social media network or hosted directly on our website. To the extent the Social Media Features are hosted by the respective social media networks, the latter may receive information that you have visited our website from your IP address. If you are logged into your social media account, it is possible that the respective social media network can link your visit to our website with your social media profile. Your interactions with Social Media Features are governed by the privacy policies of the companies providing the relevant Social Media Features.
Interactions with the Website: We use technology to monitor how you interact with the Website. This may include which links you click on, or information that you type into our online forms. This may also include information about your device or browser.
Cookies and Browser Storage: Our public website does not use advertising or analytics cookies. The booking system uses one essential cookie so that clinic staff can stay signed into the admin area. Your browser’s local storage may hold small conveniences, such as remembering that a welcome animation has already played. None of this is used to track you across other websites.
How Information Is Used
We may use the Personal Information in one or more of the following ways:
- Managing appointments and class bookings, and sending booking confirmations, reminders, receipts and invoices
- Sending information or material you request
- Responding to your questions and concerns posted on the Website
- Sharing newsletter or other marketing communications
- Operating and improving the Website
- Improving our products and services and our marketing efforts
- Conducting research and analysis
- Evaluating your job application if you have submitted it through the Website
- Linking or combining your information with other information we may receive from third parties to help better serve you
WhatsApp messages: With your mobile number we send booking confirmations, appointment reminders, and package receipts on WhatsApp through Meta’s WhatsApp Business Platform. If you would rather not receive WhatsApp messages from us, reply to any of our messages or call the clinic and we will switch you to email only.
Legal Basis for the Processing
We will only process your Personal Information if we have one of the following legal bases to do so:
- The processing is necessary to comply with our legal or regulatory obligations, such as tax reporting or regulatory requirements.
- We have obtained your prior consent for processing your Personal Information for a specific purpose, such as evaluating your job application.
- The processing is necessary for the legitimate interests of ABA, which are not overridden by your interests or fundamental rights and freedom.
Duration of Processing of Personal Information
When ABA is processing your Personal Information pursuant to any of the legal bases set out above, ABA will store your Personal Information only for as long as is required to fulfil the purpose for which it was collected. Where processing rests on your consent, ABA will stop processing your Personal Information upon notification of your withdrawal of consent for such processing.
However, wherever we are required by law to retain your Personal Information for a longer period of time or where your Personal Information is required for us to assert or defend against legal claims, we will retain your Personal Information until the end of the relevant retention period or until the claims in question have been settled.
Sharing and Disclosure of Information
ABA does not rent or sell your Personal Information. We do not share your Personal Information with third parties other than agents, contractors, and service providers who support our business and who are bound by contractual obligations to keep your Personal Information confidential and use it only for the purposes of providing services to us. These service providers currently include our website and booking hosting provider (Vercel), our booking database provider (Supabase), our email delivery provider (Resend), Meta Platforms for WhatsApp messaging, and ICICI Bank for payment processing. Each provider receives only the information it needs to do its job.
However, we may disclose Personal Information if we believe it is necessary or appropriate under applicable law for the following reasons:
- To comply with any Court order, law or legal process, including to respond to any government or regulatory request;
- To enforce or apply our Terms and Conditions or any other agreements concerning our Website; or
- To protect and defend the rights or property of ABA.
ABA may transfer your information to a buyer or other successor in the event of any reorganization, merger, sale, divestiture, restructuring, reorganization, dissolution or other disposition of all or any portion of ABA’s assets.
What Are Your Rights and How Can You Exercise Them?
You may opt out of receiving promotional emails from us by following the instructions in those emails. If you opt out of receiving promotional emails, we may still send you non-promotional emails, such as emails about our on-going business relations (if any).
You have a right to access and to obtain a copy of your Personal Information processed by us. If you believe that any of the Personal Information we hold about you is incorrect or incomplete, you may request that it be corrected.
You also have the right to:
- Object to the processing of your Personal Information
- Request the removal of your Personal Information
- Request restriction of the processing of your Personal Information, and/or
- Withdraw your consent where we obtained your consent to process Personal Information.
We will honour such request, withdrawal or objection as required under applicable data protection rules, but you should bear in mind that these rights are not absolute; they do not always apply and may be subject to exceptions. Records we are required by law to keep, such as invoices, are retained for the statutory period even after a deletion request.
Note: As required by law, we will require you to prove your identity. We may verify your identity by a phone call or email. Depending on your request, we will ask for information such as your name, contact information, or other information that may be associated with you. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete Personal Information about you in our files.
In certain circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. We will require verification that you provided the authorized agent permission to make a request on your behalf. The authorized agent must provide us with a copy of the signed permission that you have given to the authorized agent to submit the request on your behalf and you will have to verify your own identity directly with us.
Information Security
ABA understands the importance of the security of your Personal Information. In order to protect your Personal Information from unauthorized access, disclosure, alteration, or destruction, we implement technical and organizational measures that we consider appropriate in light of the state of the art, the costs of implementation, and the nature, scope, context, and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons. However, you should be aware that we cannot ensure that your Personal Information will never be accessed, disclosed, altered, or destroyed in ways not described in this Privacy Policy. By way of example, third parties may unlawfully intercept or access transmissions or private communications.
Children
Our Service(s) include care for children. Bookings for persons under the age of 18 are made and managed by a parent or legal guardian, and we collect a child’s Personal Information only from that parent or guardian, and only to the extent needed to provide care. Apart from such parent-managed bookings, the Website is not intended for use by persons under the age of 18, and any person who provides their own information to us through the Website represents to us that they are 18 years of age or older. If you are the parent or guardian of a child who has provided us with their Personal Information directly, you may contact us using the contact details set out below to request for the Personal Information to be deleted.
Complaints
If you have complaints about how we process your Personal Information, please contact us using the contact details provided below. If you are not satisfied with our response to your complaint, depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below.
International Users
Please note that we may transfer, store, and process your Personal Information outside the country you live in, including the United States. Your Personal Information is also processed by staff and third-party service providers and partners in these countries.
